Supreme Court nominee Brett Kavanaugh is a right-wing extremist who has a disgraceful judicial record when it comes to human, civil, worker’s and women’s rights. The White House and the Republican Party has also seen enough of his body of work to know that Kavanaugh, if appointed to the Supreme Court, jeopardizes the Mueller investigation.
But above all, Kavanaugh has a deeply racist record that must be highlighted during his Senate hearing so that the American people are aware of what the Republican Party is doing to the country.
What we know so far
Kavanaugh's record (what we know of it) proves he will protect corporate interests, help gut healthcare for millions of Americans, and criminalize abortion. Not only is Kavanaugh’s extensive public judicial record a case study of awfulness, there are tens of thousands of additional documents and opinions that must be so alarming, the White House and the Republican Party have taken unprecedented steps to keep them away from the American people.
Unfortunately, the now underway Supreme Court Hearing will do little to stop the Republican coordinated, calculated abuse of power. Brett Kavanaugh is set to be appointed to the highest court in the land, and there is little the Democrats can do to stop it.
For Democrats, their current predicament of oppositional futility is frustrating for them and dangerous for the country. However, they do have an opportunity to use the Supreme Court hearing to highlight his extremism and confront his regressive judicial record. The Democrats should do everything possible to make Brett Kavanaugh as uncomfortable as possible. And the best way of achieving this is to show how Kavanaugh’s record demonstrates his racism and support of racist policies.
The Democrats should come prepared to first define racism and what racist policies look like. Dr. Ibram Kendi, the award- winning author of the best-selling book: “Stamped from the Beginning,” provides some useful insight on how to do this.
How to Define a Racist
Kendi describes a racist and a racist policy this way: “A racist idea as anything that suggests that one race is superior or inferior to another, and a racist policy as any policy that produces unequal outcomes between racial groups.” He goes on to say that, “when there is inequality between racial groups, there are only two possible explanations: one group is actually inferior to the other or there is some form of discrimination.”
Of course, Kavanaugh would never say he's a racist -- he doesn't need to. The Democrats can however, highlight Kavanaugh’s horrible civil rights record as the actualization of his racism, that his judicial opinions and decisions reinforce inequality and institutional racism. It says much about Kavanaugh that the preeminent civil rights organization in the United States, the NAACP, has come out strongly against him.
"Brett Kavanaugh is a dangerous ideologue whose extreme views on civil rights would solidify a far right majority on the Supreme Court," said the NAACP in an official statement. "Coming after Neil Gorsuch’s appointment, a Kavanaugh confirmation would re-make the Court in President Trump’s own image. This prospect is unacceptable to the American people, and the NAACP is ready to lead the fight of a generation."
Over 100 civil rights organizations, including several LGBT groups across the country also oppose his nomination to the highest court of the land.
Democrats can also highlight Brett Kavanaugh’s vote to uphold the South Carolina voter ID law that intentionally discriminated against tens of thousands of minority voters as another clear example of a racist policy of voter disenfranchisement. The Democrats can connect Kavanaugh's propensity to vote or uphold racist policies as the reason why black women, social work organizations, environmental and labor organizations are coming out against his nomination.
These are just a few examples from Kavanaugh’s lengthy history of opinions and decisions that produced racist, discriminatory and unequal outcomes for millions of Americans. Democrats may not stop this nomination from succeeding, but they have a great opportunity to speak truth to the ugliest of power. Brett Kavanaugh is a human rights and civil rights nightmare and needs to be exposed in the clearest of terms.
Democratic Senators would serve themselves and the country well by framing these decisions, along with many others, as racist policies coming from a racist judge. It’s not hyperbole or slander as Kavanaugh's actions speaks louder than his words. Kavanaugh’s record defines who he was and what he intends to do on the Supreme Court. And the world needs to know about it.
